The following Terms of Use govern our relationship with our users, members and others who interact with Lava or visit or use the website, community or services offered by Lava. The following capitalized words shall be used to refer to the following definitions:
“Content” shall mean any content o.a. information, materials, documents, web pages, files, data, pictures, video’s music , etc, on or accessible via the Website or Lavapeople;
“Angel Investor” shall mean a Member of the community, who has signed up to Lavapeople under the account type ‘Angel Investor’;
“Entrepreneur” shall mean a member of the community, who has signed up to Lavapeople under the account type ‘emerging entrepreneur’ or ‘established entrepreneur’;
“Lava” or “we” shall mean the limited liability company Lava People Ltd. (for more details see the About Us section of the Terms of Use);
“Lavapeople” shall mean the online community offered by Lava which can be accessed via the Website;
“Members” shall mean any person who registers him- or herself on the Website to use or access Lavapeople or any Service;
“Member Content” shall mean all content uploaded to the Website or Lavapeople by Members;
“Services” shall mean all products and/or services offered by Lava that can be accessed and/or purchased by Users and Members via the Website or Lavapeople;
“Terms of Use” shall mean all to the complete set of terms and conditions of this document, all sections thereof, together constituting the complete legal agreement between you and Lava;
“Workspace” shall mean a separated, private area dedicated to the collaboration of group of users with a clearly defined membership and access rights to this area;
“Workspace Data” shall mean any data or documents a user creates or uploads inside a workspace;
“Workspace Services” shall mean all functionalities and services inside and related to workspaces;
“Third Party Services" shall mean all product and services offered by Lava that can be accessed and purchased via the Website and community;
“User(s)” shall mean any person (including Members) who visits, uses or otherwise interacts with the Website or Lavapeople;
“Website” shall mean the website www.lavapeople.com;
“you” or “your” shall mean Users and Members.
General Terms
1. Your relationship with Lava
It is important that you take the time to read the Terms of Use carefully. You should print off or save a local copy of the Terms of Use for your records.
Your use of the Website, Lavapeople and Services is subject to your acceptance of the Terms of Use and constitutes a legally binding agreement between you and Lava. Your agreement with Lava is made up of the following sections, collectively referred to as “Terms of Use”:

You understand and agree that Lava will treat your use or access of the Website, Lavapeople or Services as acceptance of these Terms of Use from that point onwards. If you do not agree to these Terms of Use, you may not use or access and will stop continuing the use or access of the Website, Lavapeople or Services.
Lava reserves the right, at her sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. If we make material changes to this policy, we will notify you here, by email, or through notice on our home page. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy.
Recognizing the global nature of the Internet, you agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
Use of Content and Services
2.1 In the course of using the Website Users may provide information about themselves, which may be visible to Lava, or any other User (see our Privacy Policy to learn more about information collected on this Website) and as a Member you may provide information about yourself to Lava or other Members. You understand that by posting Content on the Website or Lavapeople or providing Content to Lava (outside the private collaborative workspace area), you are granting to Lava a royalty-free, perpetual, irrevocable license to use Content in the course of offering Lavapeople and Services.
2.2 You understand that Lava retains the right to reformat, excerpt, or translate any Content submitted by you. You understand that all Content publicly posted or privately transmitted through the Website or Lavapeople is the sole responsibility of the person from which such Content originated and that Lava will not be liable for any errors or omissions in any of such Content.
2.3 You understand that Lava cannot guarantee the identity of any other users with whom you may interact in the course of using the Website or Lavapeople. Additionally, Lava cannot guarantee the authenticity of any Content which you may provide about yourselves or relationships they may describe.
Intellectual Property Rights
3.1 All intellectual property rights vested in Lava related to the Website, Lavapeople and/or Services shall remain at all times proprietary property of Lava, with all rights reserved. Users and/or Members are not allowed to modify, copy, distribute, reproduce, republish, download, display, post, transmit, or sell in any form or by any means, in whole or in part the Website, Lavapeople or Services of any content thereon, without the Lava’s prior written consent, except that the foregoing does not apply to your own Member Content that you legally upload to the Website or Lavapeople.
3.2 Lava's trademarks, -logo and -name may not be used in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Lava.
3.3 You may need to use certain software programs to use Lavapeople Some of that software is owned by Lava, or is licensed by Lava from third parties. Your use of such software is subject to these Terms of Use. The use of any software that is not owned or licensed by Lava is governed by a license agreement between you and the respective supplier of such software.
3.4 Your use of any software provided to you by Lava does not transfer any title or ownership rights in the software to you. Lava retains all its rights in software and other intellectual property, including copyrights, patent rights and rights in its trademarks and trade names.
3.5 By using software provided to you by Lava you agree that you will not disassemble, decompile, create derivative works of, reverse engineer, modify, sublicense, distribute that software or use that software for any unauthorized purpose or in contravention of any law or regulation.
4. Disclaimers
4.1 You understand and agree that the Website, Lavapeople and all Content and Services are provided to you on an “as is” and “as available” basis and that Lava does not represent or warrant that: 1) that the quality or quantity of the Content, Services, or contacts with Members, purchased or otherwise accessed via the Website or Lavapeople will meet your requirements; 2) the use of the Website, Lavapeople, the Content or Services will be uninterrupted, timely, secure or free from errors; 3) the accuracy, reliability, completeness or timeliness of the Website, Lavapeople or any Content or Service.
4.2 Lava makes no representation or warranty as to the Content or the Services purchased or otherwise accessed via the Website or Lavapeople or your reliance thereon, or your use thereof. The use of the Website, Lavapeople, or any Content or contact with Members on your own discretion and is for your own risk and liability. You will be solely responsible for any damage to your computer or loss of data that results form downloads of Content or Services for the Website or Lavapeople.
4.3 No advice or information, whether oral or written, obtained by you from Lava or through the Website, Lavapeople or any of the Services shall create a warranty or representation.
5. Limitation of Liability
5.1 You expressly understand and agree that Lava shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, date, or other intangible losses (even if Lava has been advised of the possibility of such damages) suffered by you due to, arising out, or related to these terms of use, your use of Content, Member Content, the Website, Lavapeople or any Service accessed or purchased by you, Lavapeople, whether or not such damages are based on tort, warranty, contract or any other legal theory.
5.2 Some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, accordingly some of the above exclusions may not apply to you. In that event -or in any other event- Lava’s total cumulative liability for damages arising out, or related to these Terms of Use, your use of Content, Member Content, the Website, Lavapeople or any Service accessed or purchased by you shall not exceed the amount of one hundred Euro (€100).
5.3 By accepting these Terms of Use, you agree to indemnify and otherwise hold harmless Lava, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the Website, Lavapeople or any Service; ii) unauthorized access to or alteration of your communications with or through the Website, Lavapeople or any Service, or iii) any other matter relating to the Website, Lavapeople or any Service. Any business transactions which may arise between Users and or Members from their use of the Website, Lavapeople or any Service are the sole responsibility of the involved Users or Members.
5.4 Without limitation of the terms and conditions set forth in our Privacy Policy, you understand and agree that Lava may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce these Terms of Use, or protect the rights, property, or safety of Lava, its users, and the public.
6. Termination and Enforcement
6.1 Lava may, in its sole discretion, add or remove access to any Content or Service at any time. Lava may terminate your membership, delete your account and any content or information that you have posted on the Website or Lavapeople or through any platform application and/or prohibit you from using or accessing the Website, Lavapeople or any Service or any platform application (or any portion, aspect or feature of the Service or the Site or any platform application) for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that you are under 18 or breaching any provisions of these Terms of Use.
6.3 While we have the right to monitor activity and Content associated with the Website, Lavapeople or Service, we are not obligated to do so. And since we do not, and may not have the ability to, control or actively monitor all activities and Content we don't guarantee its accuracy, integrity or quality. Because community standards vary and individuals sometimes choose not to comply with our policies and practices, in the process of using the Website, Lavapeople or Services, you may be exposed to Content that you find offensive or objectionable. In that event you can send an email to: misuse@lavapeople.com to let us know of Content that you find objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate, including, but not limited to issuing warnings, removing the Content or terminating memberships. However, because situations and interpretations vary, we also reserve the right not to take any action. Under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any content on the website.
7. Miscellaneous
7.1 You agree that if Lava does not exercise or enforce any legal right or remedy which is contained in the Terms of Use (or which Lava has the benefit of under any applicable law), this will not be taken to be a formal waiver of Lava’ rights and that those rights or remedies will still be available to Lava.
7.2 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use is invalid, then that provision will be removed from the Terms of Use without affecting the rest of the Terms of Use. The remaining provisions of the Terms of Use will continue to be valid and enforceable.
7.3 The Terms of Use, and your relationship with Lava under the Terms of Use, shall be governed by the laws of The Netherlands. The of Amsterdam, the Netherlands, shall be the only competent court to submit any disputes arising out of or related to the agreement between you and Lava. You agree that Lava shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction. These Terms and Conditions of Use will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is hereby expressly waived.
7.4 You agree not to commence or prosecute any action in connection therewith other than in The Netherlands and the competent court of Amsterdam, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenience with respect to, venue and jurisdiction of The Netherlands and the competent court of Amsterdam.
7.5 The Terms of Use make up the entire agreement between you and Lava regarding your use, access or membership of the Website, Lavapeople or any Service, and shall supersedes any prior agreements.
Collaborative Workspace Services
Definition and service provision
Lavapeople offers complimentary workspaces to all registered members that shall help them to make progress and collaborate in such activities as:
Collaborate as emerging entrepreneurs: write the business plan, prepare a pitch, or do market research
Discuss and exchange with potential investors, including the preparation of such discussions
Make the first steps in your new enterprise.
Collaborate with other entrepreneurs or investors in a workgroup type way, e.g. for networking in a region, a joint committee, angel groups etc.
Complimentary workspaces are not meant for full commercial use – i.e. running the operations of a company on them. However, users can upgrade the workspaces with additional, payable options (additional space, external user invitation) which include a license for commercial use.
Workspace services are provided by VEA B.V., Plantsoen 97, 2311-KL Leiden, Netherlands, as third party service in collaboration and under supervision of Lava. VEA provides the additional options and handles payment for them.
Privacy and confidentiality of data inside workspaces
Workspaces are private areas to which only the creator has access, or users to which the creator grants access. These users are either members of the creator’s Lava People network, or can be – as a payable option – external users that then do not receive full membership to the non-workspace areas of the Lava People website.
The creator can give other users “Administrator” rights in his workspace. This grants these users the same rights as the creator has himself, including but not limited to adding or inviting further users, renaming the workspace or changing configuration settings, buying additional options for the workspace. The creator understands that he is responsible for all actions other users have done as administrators, including, but not limited to deleting data, buying additional workspace options, adding or removing other users. If you want to keep full control over these elements, do not grant other users administrator rights in your workspace.
Users inside a workspace have full access to all data and documents inside a workspace and can change or delete them, so complicated access rights do not hamper collaboration. A log function records all actions of users for later reference.
Users that are not members of a workspace have no access to internal data or documents.
Lava and VEA B.V. take strong measure to keep all data save and confidential including:
All communication with the workspace area (ventures.lavapeople.com) is secured through Secure Socket Layer (SSL) technology and certificates. Username and password information is transmitted and stored only in encrypted format, ensuring that access is only available to users you granted access.
Lava workspaces provide each user with a unique user name and password that must be entered each time a User logs on. A session ‘cookie’ is issued only to record encrypted authentication information for the duration of a specific session. The session ‘cookie’ does not include either the username or password of the user.
The Lava website and workspaces are hosted in a secure server environment that uses full hardware firewalling with packet-inspection, virus guard and other advanced measures to prevent interference or access from outside intruders. The server environment is held in a dedicated, secure data centre with 24-hour CCTV and security.
The file and database servers use RAID technology to minimise the risk of data loss. In addition, all data is backed up on a daily rotation to off-site backup servers.
For enterprise critical files, the user has to encrypt the files before uploading them to the workspace area.
We shall not be liable for any loss or damage, howsoever arising in connection with the use of the Service or the Website, or any part thereof. We shall not be liable for any indirect, special, or consequential damages, whether such damages or losses are known, foreseen, foreseeable or unforeseen. Especially Lava and VEA cannot be held liable for any loss of data or files in the workspaces. We will take the possible measures to recover the data from backups (done once per day), should a loss of data occur.
In case a user has deleted or destroyed data or files in the workspace, we offer (if possible) data recovery from backup as a service according to effort (100€ per hour without VAT).
Your obligations related to workspace services
You shall comply with the security and administrative regulations as notified in conjunction with registration, by email or in any other manner from time to time made available on the Website.
You shall be responsible for the activities conducted through use of the Services and shall ensure compliance with national laws. All Content uploaded or posted to, transferred through, processed or entered into the Services by you shall be your responsibility.
You monitor your Workspaces and shall be liable to us for ensuring that Content transferred to or handled within the Services which is processed by You and/or individuals invited by You to do so does not infringe any third party rights nor in any other manner violates governing legislation, and that you possess such necessary licences from third parties as may be required in order to process the content/use the services. You hereby indemnify us and keep us indemnified against any and all loss suffered as a result of you breaching this Clause.
You are aware and hereby acknowledges that you are not permitted to use the services in order to get or access material in violation of law or material which in any manner contravenes generally accepted practices.
You undertake not to use the services in order to obtain material which per se or if sent to another party might injure the reputation of a third party, or in any manner which may result in the infringement of any third party’s Intellectual Property Rights, or which constitutes a dissemination of business secret, or may incite a third party to commit or participate in a crime, or may be understood as constituting a threat, or to use the Services in any other manner incompatible with the purpose thereof.
You do not attempt to invade the privacy of others, to obtain or compile data about other people’s usage of the services, or misuse the personal data of others,
You undertake not to provide access to the Services to anyone else than individuals who have completed the registration form and thereby agreed to the Terms of Use.
You agree not to use or launch any automated system, including but not limited to, “robots”, “spiders” or “offline readers” that accesses the Services in a manner that sends more request messages to Our servers in a given period of time than a single human can reasonably produce in the same period by using a conventional online web browser.
C. Membership & Referral Program
How to start or resign your membership
In order to become a Member, you have to create an account on the Website. As a Member you have access to the Content and Services of Lavapeople. To create an account you are required to provide the following contact information: name, email address, country, ZIP/postal code, a brief summary of your professional background (current occupation & networking objectives), and you will have to choose a password. You can review the personal information you provided us and make any desired changes to the information, or to the settings for your Lavapeople account, at all times by logging into your account on to Lavapeople and editing and saving your personal information.
Once you are a Member, you can always provide additional information in the account section describing your skills, professional experiences, and networking objectives. Of course it is entirely optional as to what additional information you provide beyond the minimum required at registration, but it will enable you to better identify yourself and find new opportunities in Lavapeople as well as it will improve the ability of other Members to find you or your business.
If you are a private person the annual membership fee amounts one hundred Euro (100 EURO), or the equivalent thereof in your local currency. If you are an Investor the annual membership fee amounts one thousand Euro (1000 EURO), or the equivalent thereof in your local currency. Your payment of the membership fee can by done via a payment solution on the Website provided to you and operated by Paypal (Europe) S.à r.l. & Cie (S.C.A., 5th Floor, 24-2449 Boulevard Royal L, Luxemburg) on behalf of Lava. After you have completed the payment process you will get access to the Content and Services of Lavapeople. Payment must be made by a major credit card accepted by Paypal. Lava reserves the right to change its membership fees and billing methods.
Two weeks prior to the date of your first access, you will receive a reminder to extend your membership by paying the membership fee. By payment of the membership fee your Membership will be extended from the date your membership would have expired. If you don’t pay the fee for extending your membership, Lava will block access to your account from the expiring date, until you pay the fee for renewal of your membership.
If you don’t want to extend your membership or if you wish to cancel your membership you can send an email at any time during the year with the words “cancel my membership and delete my account” in the subject line to: unsubscribe@lavapeople.com. Your membership shall be terminated and your account shall be deleted within a few days. Lava will not refund your membership fee or a part thereof, also not if you send a termination email before the expiration of your membership.
Referral program
As a Member of Lavapeople, you are entitled to participate in the referral program (“Program”) under the condition that you accept the terms and conditions of the Terms of Use. In the event of any inconsistency between any of the terms of the Terms of Use and this article 2 of section B of the Terms of Use, the terms of this article 2 of section B will prevail.
2.2 Lava rewards its members for referring Lavapeople to other people, who will become a Member (“Referral Member”). The referral fee constitutes of 25% of the membership fee that is being paid by the Referral Member. These referral fees are being rewarded to the second degree, so not only will the Member be rewarded with 25% of the fee of his own referrals, but also with 25% from the fee of the direct referrals from his own Referral Members will be paid out to the Member. The purpose of this program is to broaden the Lavapeople network.
2.3 Payments are made according to the date set upon the date of subscription. There can be a minimum threshold for payment of the referral fees. Payment processing may take approximately 4-6 weeks. Once payments are processed for the Program, no cancellations will be made.
2.4 Once a Member establishes a Referral Member and that Referral Member maintains an active Member, these referrals will not expire. This applies to two referral levels. Once a Membership is deactivated then all the referrals associated with the account are deleted. Reactivating referral Membership will not result in re-receiving the earlier referral connections; Members in that event need to start the referral connection process again.
2.5 Lava has the right to add, delete and modify the Program and referral fees at any time. If any provision of the Program is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Program and shall not affect the validity and enforceability of any remaining provisions of the Terms of Use.
Member conduct
3.1 In consideration of your use or access of the Website, Lavapeople or Services as a Member you represent and warrant that you:
will provide accurate, current and complete information about yourself as may be prompted by any registration forms on the Website ("Registration Data");
will maintain the security of your password and identification;
will maintain and promptly update the Registration Data, and any other information you provide to Lava, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account;
are at least at the age of eighteen (18) years, as the Website, Lavapeople and Services is intended solely for users who are eighteen (18) years or older, or that if you are under the age of 18 that you have consent from your parent or legal guardian.
3.2 You understand and agree not to use the Website, Lavapeople, or the Services:
to post content or initiate communications which are unlawful, libelous, abusive, obscene, discriminatory, or otherwise objectionable;
for any illegal purpose, including but not limited to conspiring to violate laws;
to falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations with a person or entity, past or present;
to upload, post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
to upload, post, email, transmit or otherwise make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights;
to upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. This prohibition includes but is not limited to a) Using the Service invitations to send messages to people who don't know you or who are unlikely to recognize you as a known contact; b) Using the Service to connect to people who don't know you and then sending unsolicited promotional messages to those direct connections without their permission; and c) Sending messages to distribution lists, newsgroup aliases, or group aliases;
to upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
to stalk or harass anyone;
to forge headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through Lavapeople or the Services;
to post content in fields that aren't intended for that content, for example: Putting an address in a name or title field;
to interfere with or disrupt the servers or networks connected to or hosting the Website, Lavapeople and/or Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Website, Lavapeople or the Services.
D. Privacy Policy.
Lava believes strongly in protecting the privacy of the personally identifiable information you share with Lava. Because the Website and Lavapeople includes areas in which Members can provide personally identifying information, our Privacy Policy (below) informs you of our policies and practices regarding information we collect about you on the Website and Lavapeople. All information that you enter or upload to Lavapeolpe will be covered by this Privacy Policy.
Information you provide at registration or in your account section is also used to provide you with Content, Services, information about Lavapeople, or to customize your experience on the Website. For example, when you login to your account we will display the screen names of new users who have recently joined your network or users whom have sent you an invite or other type of message.
To invite others to connect with you directly on Lavapeople, we ask you to copy in, or enter their names and email addresses. This information will be used by Lava to send your invitation. The names and email addresses of people that you invite will only be used to send your invitation and reminders.
Lava will not sell, rent or otherwise provide any of your personally identifying information obtained through the Website or through Lavapeople to any third party. Lava will only share your personally identifiable with other third parties to carry out your instructions and to provide specific services.
While your individual information is protected Lava reserves the right to use such individual information to create aggregated, anonymous data about Users in order to develop statistics about activity on and use of the Website and Lavapeople.
Lava does not spam or support the activities of spammers. Any sensitive information that you provide to us will be secured in accordance with industry standards. We also encourage you when you suspect a spammer is operating on Lavapeople, to bring it to our attention by sending an email with "inappropriate behaviour " in the subject line to misuse@lavapeople.com.
To improve Lavapeople and for marketing and advertising purposes Lava will make use of “cookies” to collect and store some of your personal data. A "cookie" is a small text file sent to your computer, which allows Lava to recognize your computer the next time you visit, without bothering you with another request to register. If you use the Website, Lavapeople or any of the Services, the cookie will collect and store some visitor information from you, such as, amongst others but not limited to, the Internet Protocol (IP) address of the computer, the date and time of your use. The collected and stored information shall be deleted after some time by Lava.
If, at some point after providing your personally identifying information to Lava, you do not wish to continue to receive information from Lava about the Website or about Lavapeople, you may opt out by sending an email with the words “remove my name” in the subject line to: unsubscribe@lavapeople.com.
Lava may update this Privacy Policy. In the event there are significant changes in the way we treat your personally identifiable information, we will display a notice on the Website. If you continue to use Lavapeople or any Service after notice of changes has been sent to you or published on our Website, we will take it that you therefore agree with our changed practices.
Lava may disclose personal information if we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of the Website or Lavapeople; or (4) protect the personal safety, property or rights of our Users or the public.

If you are a copyright owner or an agent thereof and believe that on the Content on the Website, Lavapeople or any of the Services made accessible though it or linked to via the Lavapeople infringes your copyrights, you may submit an infringement notice to Lava, by using the following format:
A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
Information sufficient to permit us or the service provider to contact you: postal address, telephone number, and, if available, an e-mail address;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate, and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notifications of claimed infringements of intellectual property rights can be made to by email sending an email with the words “copyright infringement notice” in the subject line to: communications@lavapeople.com.
You acknowledge that if you fail to comply with all of the above requirements for infringement notifications, your notification is not valid and may be rejected without further notice.
Any person who knowingly materially misrepresents that Content or Services are infringing their intellectual property rights and send an infringement notice to Lava under this Copyright Policy, causing Lava to remove or terminate access to such Content or Service, shall be liable for damages that might be suffered by Lava or any of the Users or Members.
